Founded in 2019, Howley Law is a boutique law firm focused on providing cost-effective client centric service to individuals and companies. Given its boutique size and cost structure combined with its sophisticated experience, Howley Law gladly works with larger firms to serve as conflict counsel, local counsel or to serve as a referral conduit to handle smaller discrete matters on behalf of clients of larger firms. We will “stay in our lane” respecting the trust inherent in an attorney referral. We will provide a positive client experience to the mutual client, then hand the client back as a satisfied customer to the larger firm – a win-win result for all. We have also developed a niche practice advising many trial law firms with regard to consulting and lift stay services in bankruptcy cases that impact current or future litigation claims.

We have helped numerous small and medium sized companies restructure and modify their debts and obligations successfully both in and out of court. Tom Howley and Eric Terry both serve as Subchapter V Trustees in small business reorganizations in the Bankruptcy Courts for the Southern and Western Districts of Texas.

Finally, we are actively involved in multiple wind down matters of previous debtors in chapter 11 cases. We can serve as counsel to the liquidating trustee or serve as the liquidating trustee or plan administrator in a cost effective manner. We have developed sophisticated and vast knowledge of wind down proceedings and are able to anticipate many issues that arise in these projects to ensure a smooth wind down of the corporate entities and timely distribution of the remaining assets to the creditors.

  • Represent an upstream and midstream company in efforts to restructure its liabilities and obligations;

  • Local Counsel to the Creditors’ Committee in Castex Energy 2005 Holdco chapter 11 cases in the Southern District of Texas;

  • Defended an international corporation against preference claims initiated in the Dean Foods chapter 11 cases and reached successful early settlement of such claims;

  • Represent numerous officers & directors as co-defense counsel along with trial law firms in responding to breach of duty claims in the context of a bankruptcy or wind down of a corporate entity;

  • Represent a furniture manufacturer in successful Subchapter V case;

  • Represent a tenant in the chapter 11 cases of CBL Associates and Washington Prime Group filed in the Southern District of Texas;

  • Represent several claimants and plaintiffs in lift stay efforts in the cases of OFS International and Basic Energy Services;

  • Represent a midstream provider in the chapter 11 cases of Fieldwood Energy in the complex reorganization of its assets into multiple different entities;

  • Represented several royalty and working interest owners in the Chesapeake chapter 11 cases in Houston and reached successful settlements with regard to their pre and post petition claims;

  • Represented landlord in Men’s Wearhouse / Tailored Brands chapter 11 cases;

  • Represent numerous unsecured creditors in Upstream oil & gas cases related to rights such as statutory lien priority versus the RBL lender, general unsecured rights and providing services post-petition pursuant to a critical vendor order;

  • Serve as the post-confirmation Debtor Liquidation Trustee in the GUE f/k/a FTD, Inc. chapter 11 cases in Delaware;

  • Represented a national franchisor with regard to a significant franchisee chapter 11 case;

  • Represent numerous private equity firms with regard to liability management options for their portfolio companies;

Fellows of the Foundation are selected for their outstanding professional achievements and their demonstrated commitment to the improvement of the justice system throughout the state of Texas.
